A mediator offers confidentiality to the process of mediation with certain exceptions. These will be made clear at the onset of any mediation process but in general where a mediator believes that a child of a family in mediation is at risk of harm, or any member of the family is at risk of harm, the mediator must explore with the couple concerned exactly the nature of such concerns and decide what must happen next.
Family mediation follows a Code of Ethics, so any allegations of significant harm to a child or any other family member involved in the dispute, would have to be considered very carefully. Consideration must be given according to whether an allegation or concern has been reported or investigated already and if not to decide what must happen next and whether to report the allegation or concern to the appropriate authority or to encourage the parties to do so themselves.
